These Terms of Use ("Terms") are a legally binding agreement between you ("you", "User") and CraftersLabs OU., a company registered under the laws of Estonia, registered address: Harju maakond, Tallinn, Kesklinna linnaosa, Kaupmehe tn 7-120, 10114 ("CraftersLabs OU.", "we", "our", "us"). These Terms govern your access to and use of the Hereo Location Tracker mobile application and related services (the "App", "Software").
Please read these Terms and our Privacy Policy carefully before using the App. If you do not agree, you must not use the App and should uninstall it immediately.
By downloading, accessing, registering, or using the App, you confirm that:
The App is provided "as is" and "as available." We do not guarantee that the App will meet your expectations or be error-free, uninterrupted, or available at all times.
We may modify these Terms from time to time. The updated version becomes effective when made available in the App. You are responsible for reviewing the Terms periodically. Your continued use of the App constitutes acceptance of the updated Terms. These Terms, our Privacy Policy, and any additional terms posted in the App are incorporated by reference.
We do not provide services to individuals or entities located in, resident in, or ordinarily resident in the Russian Federation, occupied regions of Ukraine (including the Autonomous Republic of Crimea), Cuba, Iran, North Korea (DPRK), Sudan, or Syria, or any other jurisdiction subject to comprehensive sanctions where providing the App would be prohibited by law.
We do not conduct business with companies owned by or affiliated with citizens or residents of the above jurisdictions.
We reserve the right to deny access or terminate this Agreement without compensation or refund to any person or entity that, in our reasonable opinion, supports aggression against Ukraine (including paying taxes/fees to the aggressor state) or is affiliated with countries promoting such aggression.
The App uses GPS technology to help you view and share real-time locations with people you trust on a private live map. With Circles, you can create groups where members share their locations within the group, enabling you to view current location and location history (subject to your plan).
Members can be invited using a unique private 6-digit code. Once a person accepts the invitation and consents to location sharing, you can see their location in the Circle.
Subject to these Terms, we grant you a personal, worldwide, revocable, non-transferable, non-exclusive license to access and use the App for your private, non-commercial purposes only. This license exists solely to enable you to enjoy the App's features as described herein.

Pricing & plans. The available subscription options and prices are shown in the App. Purchases are processed by the Apple App Store. Refunds are governed by Apple's rules.
Free trial. Some subscriptions may include a free trial. After the trial ends, your plan converts to a paid subscription unless you cancel before the trial expires.
Auto-renewal. Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period. Payment will be charged to your Apple ID account upon confirmation of purchase and at renewal. You can manage/cancel in your Account Settings on the App Store.
The App may depend on or link to third-party websites and services. We do not control and are not responsible for such services, their content, features, or policies. Your use of third-party services is governed by their own terms and privacy policies. We disclaim liability for losses or damages arising from your use of any third-party site, service, content, or feature.
You agree to defend, indemnify, and hold harmless CraftersLabs OU., its affiliates, licensors, and their respective employees, officers, agents, and contractors from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you; you agree to cooperate with our defense.
To the maximum extent permitted by law, we and our partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or other intangible losses) arising out of or related to:
These limitations apply whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
Your use of the Software is at your sole risk. The Software is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance.
We do not warrant that the Software will be uninterrupted, secure, or available at any particular time or location; that any errors or defects will be corrected; that the Software is free of viruses or other harmful components; or that results will meet your requirements. Some jurisdictions do not allow exclusions or limitations; in such cases, portions of this section may not apply to you.
We collect and process personal data to provide the App. Please see our Privacy Policy for details on what data we collect, how we process it, and your rights.

These Terms are governed by and construed under the laws of Estonia.
Before filing any claim, the parties shall attempt to resolve disputes amicably by contacting us at oleg@crafterslabs.com. We aim to respond within 14 days.
If no settlement is reached, any dispute, controversy, proceeding, or claim arising out of or relating to these Terms or their formation shall be subject to the exclusive jurisdiction of the competent courts of Estonia, without regard to conflict-of-laws rules.
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted to reflect the parties' intent, and the remainder will continue in full force and effect. A printed version of these Terms shall be admissible in judicial or administrative proceedings.
By us. We may modify, suspend, or discontinue the App (in whole or part), or terminate/suspend your license and access if:
We may take any lawful actions in response to actual or suspected violations, and we will cooperate with authorities where required.
By you. You may terminate this Agreement by canceling your account (if applicable) and discontinuing use of the App.
Effect of termination. Upon termination, all rights and licenses granted to you under these Terms will immediately cease. No refunds are owed unless required by applicable law or Apple's rules.
We continually improve our service. Accordingly, our Terms may be updated and supplemented. We will provide notice within the App before material changes take effect so you can review the new terms.
We may freely assign our rights and/or obligations under these Terms. You may not assign, transfer, charge, license, or otherwise dispose of these Terms or any rights/obligations hereunder without our prior written consent.
Upon termination, provisions that by their nature should survive (e.g., ownership, disclaimers, limitations of liability, indemnities) shall survive.
All claims between the parties must be litigated individually; the parties will not consolidate or pursue class treatment unless agreed in writing.
